Trademark monitoring and Journal Watch

Track what changed on your trademarks, catch similar marks in the weekly Trade Marks Journal in time to oppose them, and see where the Registry has cited your mark against a new application.

Trademark monitoring in TM Manager is automatic. Once your marks are in your portfolio, it checks them on the Indian Trade Marks Registry and in every new Trade Marks Journal for you. You don't need to look each one up. What it finds shows in three places under Monitoring & Watch in the sidebar:

All Updates: trademark status tracking

All Updates lists everything that happened to your marks, newest first. Use Show to pick what you see:

  • Needs attention: things you may have to act on, such as a hearing, an objection, an opposition against your mark, a renewal due, or a close match in the journal.
  • Results: final outcomes, such as accepted, registered, refused or abandoned.

You can also filter by client and by date. Two tabs give a quick list:

  • Status Changes: each mark whose status moved, for example from Objected to Accepted.
  • New Documents: each new document on file in the last 3, 7 or 30 days, such as an examination report, a hearing notice or a registration certificate.

Deadlines are colour-coded so you don't miss them: amber when 30 days or less are left, red when 7 days or less are left.

Journal Watch: find similar marks in the Trade Marks Journal

Every week the Registry publishes the Trade Marks Journal, listing new applications it has accepted. If one of them is too close to your mark, you have four months from the journal's date to file a trademark opposition. After that, it is much harder to stop.

Journal Watch compares each new journal with your portfolio and lists the marks that come close to yours.

  1. Pick a journal at the top.
  2. View the matches by Your marks (each of your marks, with the journal marks close to it) or by Journal marks.

Reading a match

Each match tells you how close it is, in what way, and whether the goods or services overlap.

What it means
SimilarityHigh (worth a close look) or Moderate
Match typeIdentical, Contains (your mark is inside theirs, or theirs inside yours), Looks alike, Sounds alike, Same meaning, Overall resemblance
ClassSame class (they share a class with you), Same or related (same class, or goods and services close to yours), Cross class (no class in common), All classes

The closest matches are listed first.

Narrowing the list

  • More filters: class groups (for example Food and drink, Fashion, Software and tech), status and tags.
  • Bookmark a match you want to come back to, then turn on Bookmarked only.
  • Ask AI whether to oppose: the AI Assistant compares the two marks and gives you its view, to help you decide.

Citations: when an examination report cites your mark

When the Registry examines a new application, its examination report may list earlier marks that look like a conflict. Citations shows the applications where your mark was listed this way. Open the report with Open examination report.

This is an early warning: you learn about a close mark before it reaches the journal. Once that application is published in the journal, you can oppose it. Turn on Opposable only to see just the ones you can still oppose, with the days left.
