Trademark renewal in India

A registered trademark in India is valid for 10 years and can be renewed again and again. Here's when to renew, what happens if you miss the date, and how to keep track of every renewal.

A registered trademark in India is valid for 10 years. Renew it every 10 years and it can last for as long as you use the brand. Forget, and you risk losing the registration and the protection that comes with it.

Key dates

WhenWhat you can do
Up to 1 year before expiryfile the renewal (Form TM-R)
Up to 6 months after expiryrenew with an extra fee (surcharge)
After that, up to 1 year after expiryask for the mark to be restored and renewed
Laterthe mark can be removed from the register, and you may need to file again

The 10 years are counted from the date of application, not the date of registration. So a mark that took three years to register has seven years left when you receive the certificate.

Why renew on time

  • Protection continues without a gap. A lapsed mark is harder to enforce.
  • Others can't take it. A removed mark is open for others to apply for.
  • It costs less. Renewing before expiry avoids the surcharge and the restoration process.

How TM Manager helps

  • Renewal tasks, automatically: when a registered mark in your portfolio is within a year of expiry, TM Manager creates a Renewal Pending task with the expiry date.
  • Clear warnings: deadlines turn amber 30 days out and red 7 days out.
  • Every mark in one view: filter your portfolio and tasks by client or tag to plan renewals for a whole client or brand at once.
  • Done when filed: once the renewal appears on the Registry, the task is marked completed.
  • Client updates: export upcoming renewals as Excel or PDF to send to clients or management.

Quick checklist

  1. Add every registered mark to your portfolio.
  2. Check Tasks for Renewal Pending each month.
  3. Confirm the mark is still in use and the owner's details are current.
  4. File the renewal well before the expiry date.
