How to oppose a trademark in India
Someone has applied for a mark close to yours? Here's how trademark opposition works in India, the deadlines at each stage, and how to spot similar marks in the Trade Marks Journal in time.
Registering your trademark is only half the job. The other half is stopping others from registering marks too close to yours. In India, the main way to do that is a trademark opposition, and it has a strict deadline.
Where new marks are published: the Trade Marks Journal
When the Registry accepts an application, it publishes the mark in the Trade Marks Journal, which comes out every week. Publication invites anyone who objects to the mark to oppose it.
Thousands of marks appear in each journal. Reading them by hand is slow and easy to get wrong, especially if you look after many marks.
The deadline: four months
You can oppose a published mark within four months of the date the journal is made available. This period can't be extended. If you miss it, your options become harder and more expensive, such as asking later for the registration to be cancelled.
The opposition process, step by step
| Stage | Who | Time limit |
|---|---|---|
| Notice of opposition (Form TM-O) | opponent | within 4 months of the journal |
| Counter statement | applicant | within 2 months of receiving the notice |
| Evidence in support of opposition (Rule 45) | opponent | within 2 months of receiving the counter statement |
| Evidence in support of application (Rule 46) | applicant | within 2 months of receiving the opponent's evidence |
| Evidence in reply (Rule 47) | opponent | within 1 month of receiving the applicant's evidence |
| Hearing | both | on the date the Registry sets |
If the applicant doesn't file a counter statement in time, the application is treated as abandoned. Missing an evidence deadline can mean the opposition, or the application, is treated as abandoned too.
How TM Manager helps
Catch similar marks in every journal
Journal Watch compares every mark in each new journal with your portfolio and lists the close ones. Each match shows:
- how similar it is: High or Moderate;
- how it's similar: identical, contains your mark, looks alike, sounds alike, same meaning, or overall resemblance;
- class overlap: same class, related goods and services, or a different class.
Bookmark the ones to act on, and ask the AI Assistant whether a mark is worth opposing.
See conflicts before they're published
Citations shows new applications where the Registry's examination report lists your mark as a possible conflict. You learn about them early, and once they're published you can see the days left to oppose.
Never miss a step
Whether you're the opponent or the applicant, every stage above becomes a task in Tasks with its due date: the counter statement, each evidence affidavit and the hearing. When the filing appears on the Registry, the task is marked done.
